1. Introduction

1.1 These terms and conditions apply to the purchase of digital house plans from Marcus Design Inc, available at shop.marcusdesign.ca. By purchasing a house plan, you agree to be bound by these terms and conditions.

1.2 Marcus Design Inc reserves the right to modify these terms and conditions at any time.

2. Intellectual Property Rights

2.1 All intellectual property rights in the house plans, including without limitation, copyrights, trademarks, and trade secrets, are owned by Marcus Design Inc.

2.2 The house plans are provided for your personal use only. You may not share, copy, sell, or otherwise distribute the house plans without the express written consent of Marcus Design Inc.   Limited distribution required for construction.

Third party agreement: The purchaser can distribute this plan to contractor(s)/builder(s), sub-trades, suppliers, consultants and municipality for pricing, engineering, permit and construction purposes (for this single build).  Said third parties cannot reuse, resell or hand out this plan (or any part of it).

3. Delivery

3.1 The house plans will be delivered to you in digital format via email. Delivery will be made automatically on the day of your purchase.

3.2 You are responsible for ensuring that you have the necessary software and hardware to access and use the digital house plans.

4. Refunds and Returns

4.1 Due to the nature of the digital product, Marcus Design Inc does not offer refunds or returns on house plans once they have been delivered.

5. Disclaimer of Warranties

5.1 The house plans are provided “as is” without warranty of any kind, either express or implied, including without limitation, the implied warranties of merchantability and fitness for a particular purpose.

5.2 Marcus Design Inc does not guarantee that the house plans will meet your specific requirements or that the use of the house plans will be uninterrupted or error-free.

6. Limitation of Liability

6.1 In no event shall Marcus Design Inc be liable for any damages, including without limitation, direct, indirect, special, incidental, or consequential damages, arising out of the use of the house plans.

6.2 Your sole and exclusive remedy for any claim arising from the purchase of the house plans is the delivery of a replacement copy of the house plans.

7. Governing Law

7.1 These terms and conditions shall be governed by and construed in accordance with the laws of the Canada. 

8. Entire Agreement 

8.1 These terms and conditions constitute the entire agreement between you and Marcus Design Inc relating to the purchase of the house plans.

By using the shop.marcusdesign.ca website and purchasing a house plan, you agree to be bound by these terms and conditions.

 

DISCLAIMER for CONSTRUCTION SET purchases:

These plans have been drawn according to high quality standards and practices and are an accurate guide to building construction.  (Referred minimum standard; National Building Code of Canada – Part 9 / Housing and Small Buildings).

Notwithstanding, all work shall confirm to the current building codes adopted by authorities having jurisdiction and local building codes and/or bylaws which may take precedence, and as such, these plans may require changes.

The home owner/purchaser is responsible for the verification of municipal regulations.

The city or municipal building inspector may require the affixed seal of a certified architect or engineer for safety reasons or particular regulations.  Additional engineering plans may be required.  Acquiring these is the responsibility of the homeowner/purchaser or builder/contractor.

Marcus Design Inc does not provide on-site supervision over the actual construction and assumes no responsibility for any damage due to any errors or omissions in these plans.  The builder/contractor is responsible to check all drawings, details, dimensions and notes and report any discrepancies or errors to Marcus Design Inc.

Marcus Design Inc will not assume liability for mishaps before, during or after the use of these plans for construction.

These plans to be read in conjunction with sub-trade’s / supplier’s / manufacturer’s recommendations, specifications and/or shop drawings (not included in these plans).

This home plan has been originally designed and drawn by Marcus Design Inc and is its exclusive property.  Any reproduction is strictly prohibited.
